The National Law Journal, for its article “Court Seats Filling Up,” quoted Akin Gump policy partner Ed Pagano on the Democratic Party’s focus on moving appeals court nominees through the Senate before the last two years of President Obama’s term.

The article noted that, since March, the average number of judicial confirmations per month has been 11, compared to an average of four in the preceding years of the Obama presidency. Pagano noted that this increase in nominations may indicate that the Democratic Party feels that, should it lose control of the Senate, confirmation votes by a GOP-controlled Senate would be “few and far between” in the president’s final term years. He added, “I think you can say the result is the president will leave a progressive stamp on the judiciary.”
