Anthony Pierce and Jonah McCarthy, partner and counsel, respectively, in Akin Gump’s litigation practice, have written an article for Today’s General Counsel that looks at the pros and cons of arbitration versus litigation in resolving disputes.

The article, “Arbitration – Litigation Choice Not Always Obvious,” says counsel should “make a careful and informed decision” before choosing which option to pursue. While arbitration and litigation both “involve the same elements, for the most part, and they embody many of the same fundamental concepts,” one key difference is that in arbitration, “the parties must pay someone to resolve the dispute.”
