Westlaw Publishes Kohne and Schaffner Article on 2018 Cybersecurity Trends

Westlaw Journal Corporate Officers & Directors Liability has published the article “Major cybersecurity and data privacy trends and issues to anticipate in 2018,” written by Natasha Kohne and Diana Schaffner, partner and counsel, respectively, in the cybersecurity, privacy and data protection practice, which Kohne co-leads, at Akin Gump.
The article previews what the authors say will be a “benchmark year for cybersecurity and data privacy litigation and regulation.” They expect it to be a busy time “with respect to court activity, regulatory enforcement, and the continuing development and clarification of legislation.”
Among the specific issues to watch in 2018, according to Kohne and Schaffner, are the following:
- “the applicability of the attorney-client privilege and work product protection in the context of a cyberincident”
- key developments in consumer privacy litigation, in both the United States and European Union
- the ability of local governments to expand the reach of their cybersecurity and privacy statutes
Kohne and Schaffner conclude by noting that 2018 is likely to be “an active year in the evolution of cybersecurity and data privacy law.” As new legislation takes effect, they add, “judicial interpretation should help us improve compliance and readiness and mitigate risks.”
