A recent blog posting by Akin Gump tax partner David Burton that appeared on TaxEquityTelegraph.com has been republished by the website of Windpower Engineering & Development.

Burton, in “PTC “start of construction” clarifying guidance expected in a week or two,” writes that the IRS is soon likely to issue new guidance on the production tax credit (PTC), clarifying what is required for a wind energy project to be deemed to have started construction in 2013 in order to be eligible for the PTC. The guidance, he notes, is in response to requests from many in the wind industry.

Releasing the guidance in the next week or two, Burton writes, would be good news for the wind industry, but he adds that “July and August are traditionally slow periods for the issuance of tax guidance.”
