Our IP lawyers work in conjunction with lawyers from other practices within the firm to deliver a combination of services, both traditional and innovative. Our approach to IP strategy provides a plan, not just to strengthen future IP positions, but also to maximize revenue generation from existing IP assets. We understand that our clients are always under pressure to do more with less so we form partnerships with our clients’ business units to identify IP monetization opportunities while managing risk and cutting costs.
IP Audits and Portfolio Development. Following a thorough understanding of our clients’ competitive advantages and core competencies, we can provide an IP audit to ensure that the investments associated with obtaining and protecting IP rights yield true business value for our clients.
In conjunction with an IP portfolio analysis and audit, we can evaluate a company’s process for ideas to market and create best practices to maximize protection of existing products, as well as to establish “stakes” in developing areas for future exploration.
Competitor Landscape Assessment. An IP landscape assessment identifies key players and patents in a given market space. Areas of opportunity are also identified, including new possible avenues of product development.
IP Valuation and Portfolio Optimization. Our IP valuations help clients structure and understand their current IP portfolio against the market. To ensure a holistic approach to IP valuation, we collaborate with lawyers in our other practices including corporate, investment funds, government contracts, private equity, and financial restructuring. We can also assess areas of strength, as well as areas where additional IP may be useful.
Target Assessment. If a new product line is in development and/or when our clients are considering purchasing or licensing third-party IP rights, we can review the target IP to assess the likelihood of future infringement challenges arising from those IP rights, as well as ensure that the target IP assets support our clients’ overall business objectives.
IP Monetization. Clients are usually surprised at the volume of stagnant IP in their portfolios. We can provide an IP monetization program for those assets, focused on extracting maximum value from existing IP. Through such a program, we would advise which IP assets could be asserted in order to increase barriers to entry for our clients’ competitors, as well as which IP rights could be licensed or transferred to third parties in order to generate revenue in a manner which aligns with our clients’ overall business objectives.
