On March 5, 2013, Children’s Physician Services of South Texas and Radiology Associates agreed to pay $1.5 million and $800,000, respectively, to settle a whistleblower suit brought under the federal False Claims Act and the Texas Medicaid Fraud Prevention Act. The U.S. DOJ and the Texas Attorney General accused the health care providers of double-billing the Medicaid and Medicare programs for the same radiology services. According to a court docket entry, the whistleblower, a former Radiology Associates employee, will receive 21 percent of the recovery, exclusive of attorneys’ fees.
