The Use of Interim Declarations in International Commercial Arbitration: An Excellent Remedy

Indian Journal of Arbitration Law has published the article “The Use of Interim Declarations in International Commercial Arbitration: An Excellent Remedy,” written by Akin Gump international arbitration and dispute resolution partner Hamish Lal, counsel Brendan Casey and associate Tania Iakovenko-Grässer.

In the article, the authors write that an arbitral tribunal’s award of declaratory relief is an efficient approach to international arbitration, particularly when the facts of the matter are undisputed or not needed to decide a legal right or obligation. However, there is question as to whether they can and should “issue declaratory awards at early or interim stages.”

The authors suggest that “interim declarations serve a fundamental purpose and should naturally be explored more often than the current empirical data indicates.”
