Akin Appellate Win for Armistice Capital Receives Litigator of the Week Shout-Out from The American Lawyer’s Litigation Daily

An Akin appellate team has earned a Litigator of the Week “shout-out” from The American Lawyer’s Litigation Daily. The Akin team was led by investment funds litigation head Douglas Rappaport and partner Kate Shapiro; and included appellate partner James Tysse and litigation counsel Michael Chen.
The team is recognized for securing a win for Armistice Capital in the Second Circuit in the matter of Roth v. Armistice Capital et. al., which fully affirmed the District Court’s summary judgment decision dismissing an action seeking disgorgement of $87 million. This precedential decision brings five years of litigation to an end and further solidifies an important issue under Section 16(b) for investment funds.
This win marks Akin’s fourth victory for Armistice Capital in the past sixteen months.
