The article examines the legal, reputational and commercial risks that foreign companies and individuals may face when responding to congressional inquiries. The authors discuss the limits of Congress’ ability to compel testimony and document production abroad, as well as practical considerations for multinational companies navigating congressional scrutiny, regulatory attention and broader risk management concerns.
The authors conclude that congressional inquiries should not be considered solely through a legal lens, “Congressional investigations can spill over into regulatory and litigation risk. Non‑US companies should treat congressional engagement as part of a broader global risk‑management strategy.”
