Biography
  • Co-leads the firm’s congressional investigations practice.
  • Served on the House Judiciary Committee as Senior Advisor and Special Counsel.
  • Advises clients in connection with congressional investigations and related crisis management, high-stakes government investigations, sensitive internal investigations and litigation.

Marcus helps clients navigate all aspects of congressional and other government investigations, public hearings, as well as related litigation. Leveraging his deep knowledge of Capitol Hill, Marcus advises companies in responding to congressional inquiries, preparing executives for testimony and developing sound strategies to manage parallel criminal and civil proceedings.

Prior to joining Akin, Marcus served as Senior Advisor and Special Counsel to Representative Jamie Raskin, Ranking Member of the U.S. House Committee on the Judiciary. In that role, Marcus led all aspects of sensitive investigations that spanned industries such as technology, higher education, health care and financial services, among others. Earlier in his career, Marcus also served as an Assistant Staff Judge Advocate for the U.S. Air Force and a Special U.S. Attorney for the Middle District of Georgia, where he prosecuted Airmen charged with serious criminal offenses.

In addition to his experience in government, Marcus has significant prior experience in private practice as a white collar defense attorney, giving him deep insight into how investigations unfold on both sides.

Representative Work
  • Advised a national bank in connection with a House Judiciary Committee investigation related to the Bank Secrecy Act and allegations of debanking. Successfully prevented the Committee from issuing a subpoena and minimized media attention related to the bank’s involvement in the congressional investigation.
  • Represented an energy company in a congressional investigation and prepared its chief executive for testimony before the House Natural Resources Committee.
  • Represented a multinational restaurant chain in connection with inquiries from the House Judiciary Committee.
  • Represented a prominent pharmaceutical company in connection with congressional inquiries related to the price of prescription drugs.
  • Conducted an internal investigation on behalf of a government contractor in the engineering industry and prepared a senior company executive for congressional testimony.
