Bloomberg Law Quotes Suzanne Kane on Section 301 Tariff Challenge

Akin Gump international trade partner Suzanne Kane has been quoted in the Bloomberg Law article “Importer Challenges Section 301 Tariffs on Chinese Oil Well Pump.” The article reports on a challenge by Endurance Oilfield Equipment Inc. in the U.S. Court of International Trade to a determination by the Trump administration that the company’s imported oil well pump should be subject to President Trump’s tariffs on Chinese goods.

According to Bloomberg, the administration argued that the tariffs were a necessary response to unfair Chinese trade practices. It is a type of classification dispute, the article says, that will become much more common.

Kane said the case illustrates the scrutiny that Customs and Border Protection brings on goods subject to the China tariffs.

“We’ll start seeing more litigation of these type of classification cases,” Kane noted. For importers who can afford it, litigation is “one of the few ways they can get certainty these days,” she said.
