Akin Gump international trade partner Christian Davis was quoted in an article by The Associate Press, “TikTok Sues Trump Over His Pending Order to Ban Its App,” which discusses the video app’s suit against the Trump administration.

The article notes that getting a court to overturn the government’s view that TikTok is a threat to national security would be difficult. Davis, whose practice includes working with clients on foreign investment and international trade matters, said that the administration has significant discretion on national security. He noted that due-process claims could be easier to argue, but added that issues in this regard could be “cured” by modifying the order.
