Law360 has quoted Akin Gump international trade partner Christian Davis in the article “Confusion Prevails Over Extent Of Trump’s TikTok ‘Ban’.” The article reports that President Trump’s efforts to “ban” TikTok have led to some confusion as to how exactly the Chinese social media platform will be targeted.
In a pair of orders last week, Law360 reports, Mr. Trump cited TikTok and the messaging app WeChat as threats to national security. As a result, U.S. companies will be prohibited from conducting “transactions” with their Chinese parent companies. The Department of Commerce will be responsible over the next several weeks for determining which transactions will be banned.
Several options are on the table, the article says, but, according to Davis, the move has left many scrambling to ascertain the scope of the White House’s plans.
“We’re trying to understand more clearly what would actually be included as a ‘transaction’ that would be identified,” said Davis. “There is the potential that this could be as broad as a sanctions designation, or it could be much more narrow and apply to very specific types of transactions. I am trying to understand what the aims of the government are.”
