Devin Sikes Quoted in Law360 on CIT Ruling in National Security Tariff Case

Devin Sikes, counsel in the international trade practice at Akin Gump, has been quoted in the Law360 article “CIT Ruling Reining In Trump Tariffs Offers Hope For Importers.” The article addresses a ruling by the U.S. Court of International Trade setting limits on the Trump administration’s use of national security tariffs.

According to Law360, the three-judge panel at the CIT ruled that, while President Trump has the authority to restrict trade for national security reasons under Section 232 of the Trade Expansion Act of 1962, he has to follow clearly delineated timelines covered by the law. This would give Mr. Trump a total of 105 days to act after the Department of Commerce completes its security assessment.

Sikes said the CIT ruling, a win for the steel importer Transpacific Steel LLC, means that the court’s rationale would “seemingly apply with equal force” to any suits focused on finished goods.
