Akin Gump Supreme Court and appellate practice co-head Pratik Shah participated in a panel hosted by Washington Legal Foundation (WLF) titled “The U.S. Supreme Court: October Term 2019 Preview.”
The panel focused on issues and trends that the Court will face in the new Term, as well as their impact on the business community, which the WLF supports through its litigation, education and advocacy efforts.
Shah discussed noteworthy cases in the upcoming Term on topics such as age and race discrimination and the Affordable Care Act, pending certiorari petitions involving the Americans with Disabilities Act and the Alien Tort Statute, and questions surrounding themes that will be carried over from the last Term:
- Which Justice will emerge as the swing or median vote on the Court and which case(s) in the new Term will reveal the alignments on the Court, particularly as concern the newer Justices, Kavanaugh and Gorsuch?
- How will the Court handle the doctrine of stare decisis, in other words, deferring to precedent in the Court’s decisions?
The panel was recorded and can be viewed here. Additionally, Pratik Shah discussed the previous Term and previewed the new Term in the latest episode of the OnAir with Akin Gump podcast series, available for streaming here.
