Rafi Prober Quoted in National Law Journal on What to Expect with Congressional Investigations During the Biden Administration

Akin Gump congressional investigations practice co-head Rafi Prober has been quoted in The National Law Journal’s “Compliance Hot Spots” column on his expectations for investigations activity in the new Congress.

Looking ahead to a Biden administration, House Democrats, the article says, are expected to direct more of their attention to investigating powerful companies after two years focused largely on oversight of President Trump and his administration.

“The last two years saw a tremendous amount of congressional investigative activity, notwithstanding an impeachment and a pandemic,” said Prober. “That’s quite telling when you think about how much activity there was, putting aside two monumentally consequential events that impacted the landscape in terms of bandwidth. Starting there, I think losing the foil of the Trump administration, that investigative energy will need to go somewhere.”

Continuing, Prober said, “I actually think the investigations of the private sector will pick up considerably as Democrats move back to some of the existing investigations and topics but also investigations that underscore their legislative and policy priorities.”

Compounding the stakes for corporate America, Prober added, is an expected uptick under the Biden administration in investigations from regulatory and enforcement agencies, as it “relates to [parallel] congressional inquiries.”
