Rafi Prober, co-head of the congressional investigations practice at Akin Gump, has been quoted by The Wall Street Journal in the article “Democrats Adopt GOP Strategy in Fight for Trump Probe Information.” The story reports that House Democrats, now in the majority, are expecting the same level of access to certain information that Republicans once enjoyed.
The fight over access, according to the article, is likely to get heated, with Democrats already saying they would seek the report being prepared by Special Counsel Robert Mueller into Russian interference in the 2016 election as well as other material related to President Trump’s businesses, charitable foundation and governance. Democratic lawmakers, the article adds, say previous Trump administration decisions have set a precedent for the Justice Department, which plays a broad role in supervising criminal investigation and some intelligence gathering.
“These principles really do matter a ton, and have always been a key consideration over the years in the interaction between the executive branch and Congress. Once you bend on one or two, it makes it harder to say that Congress doesn’t have a right to know down the road,” said Prober.
