- Represents clients in all phases of government investigations and civil enforcement proceedings relating to health care services, pharmaceutical and medical devices, payment of customs duties and tariffs, pandemic relief programs, government loan and grant programs, small business contracting and federal procurement.
- As a former senior career official with DOJ, spearheaded FCA enforcement efforts in hundreds of complex fraud investigations nationwide, working closely with all 93 U.S. Attorneys’ Offices, federal law enforcement agencies and State Attorneys General.
- Negotiated more than 100 FCA settlements across a wide range of federal agencies and programs, along with dozens of settlements relating to conflicts of interest, breach of contract, agency overpayments and common law claims.
Colin is an accomplished litigator and pragmatic problem solver who possesses a notable skill set shaped by nearly two decades of service at the U.S. Department of Justice (DOJ) that he utilizes to provide compliance counseling and representation to clients managing False Claims Act (FCA) investigations and other civil enforcement matters.
He represents clients in all stages of proceedings, from early risk assessment and compliance counseling to internal investigations and government-facing inquiries and litigation. Colin brings a steady hand and deep understanding of enforcement strategies that allow him to credibly and effectively advocate for his clients seeking to minimize business disruptions and reputational harm.
Prior to joining Akin, Colin spent 18 years with DOJ’s Civil Fraud Section, the last six as a Deputy Director supervising more than 125 attorneys investigating and litigating complex civil fraud matters nationwide. His work encompassed hundreds of investigations and litigation relating to hospital and physician providers, pharmaceutical and medical device manufacturers, customs duties and tariffs, government contracts, pandemic relief programs, small business contracting programs, government loan and grant programs, and conflict of interest violations. He managed a broad portfolio, securing more than $4 billion in total recoveries during his time with DOJ.
While serving in senior leadership positions at DOJ, Colin played a key role in shaping nationwide FCA enforcement policy under different administrations, including playing an integral role in the development and implementation of policies relating to the dismissal of qui tam actions. He routinely advised DOJ leadership and attorneys on policies and practices regarding voluntary self-disclosure, parallel proceedings, global resolutions and cooperation credit in negotiated resolutions. Colin also served in senior leadership positions on a variety of inter-agency task forces and working groups where he helped shape FCA enforcement priorities, including Deputy Director of the COVID-19 Task Force that secured more than $850 million in civil settlements and judgments relating to alleged fraud and overpayments in connection with pandemic relief programs, and as a principle member of the Department’s Trade Fraud Task Force and Department of Health & Human Services (HHS) FCA Working Group.
A recognized thought leader on the FCA, Colin is a frequent speaker on topics relating to enforcement trends and legal developments, and during his time in government he received awards for his work training hundreds of DOJ attorneys, agency counsel and law enforcement personnel on FCA investigations, litigation and settlement.
Prior to his time in the government, Colin practiced at another international law firm where he represented clients in a variety of government investigations and complex commercial disputes.
Colin began his legal career as a law clerk for the Honorable Morton I. Greenberg at the U.S. Court of Appeals for the Third Circuit and the Honorable J. Garvan Murtha at the U.S. District Court for the District of Vermont.
He holds a J.D. from Georgetown University Law Center, where he was a Henry Kaiser Scholar, and a B.A. magna cum laude from Georgetown University.
- Health Care: Led dozens of investigations of hospital systems and physician providers concerning allegations relating to billing, coding, unnecessary services, substandard care, kickbacks, impermissible self-referrals, clinical trial costs and improper retention of overpayments, resulting in dozens of negotiated settlements totaling hundreds of millions of dollars.
- Life Sciences: Conducted scores of investigations relating to pharmaceuticals, medical devices, biologics, nutritional products and other U.S. Food and Drug Administration (FDA)-regulated products to assess potential FCA liability resulting from alleged kickbacks, promotion of unapproved/noncleared uses, material product defects, fraudulent regulatory submissions, adverse event reporting and Current Good Manufacturing Practice (cGMP) violations. Negotiated settlements totaling more than $3 billion across a wide range of products, including prescription drugs, combination products, orthopedic implants, cardiac rhythm management devices, spinal fusion and fixation devices, neuromodulation devices, point-of-care testing devices and allograft skin substitutes.
- Customs: Directed and supervised numerous investigations relating to allegations of unpaid customs duties involving antidumping/countervailing duty circumvention, undervaluation, transshipping, product misclassification and false country of origin. Secured settlements totaling hundreds of millions of dollars and implicating a wide variety of imported merchandise, including pharmaceuticals, medical devices, extruded aluminum products, steel, magnesium, refrigerants, plastic resin, quartz surface products, multilayer wood flooring, furniture, jewelry and apparel.
- Pandemic: Served as Deputy Director of DOJ’s COVID-19 Fraud Enforcement Task Force, spearheading civil enforcement relating to all pandemic relief programs, which resulted in civil settlements and judgments of more than $850 million across programs administered by the Small Business Administration (SBA), HHS, Department of the Treasury and Pension Benefit Guaranty Corporation (PBGC). Supervised investigations of thousands of Paycheck Protection Program (PPP) borrowers, in addition to dozens of lenders and fintech companies that participated in PPP. Spearheaded the creation and implementation of customized data analytic tools adopted throughout DOJ, including all U.S. Attorneys’ offices, to identify potential fraud.
- Procurement: Led and supervised investigations of government contractors for alleged misconduct involving defective and nonconforming goods, false and inflated pricing data, labor rate classifications, and a variety of small business contracting and set-aside programs.
