Andy Rosbrook is a seasoned patent litigator and trial lawyer who handles high-stakes proceedings in federal district courts nationwide, before the U.S. Court of Appeals for the Federal Circuit, in private arbitrations and at the U.S. Patent and Trademark Office. His practice spans the full lifecycle of IP disputes, from pre-suit investigation and strategy through trial, appeal and enforcement of judgments.
Andy takes a holistic, strategic approach to each engagement, working to understand clients’ business and competitive landscapes so that his clients’ legal strategies advance their commercial objectives. He has first-hand experience in every phase of litigation – developing case themes, managing complex fact and expert discovery, taking and defending depositions, arguing claim construction and dispositive motions, and examining witnesses at trial.
- Representing an agricultural biotechnology company in a combined patent infringement and trade secret action in the Western District of Wisconsin, while simultaneously defending against antitrust claims challenging the client’s patent acquisition and licensing practices, a matter requiring detailed coordination of the client’s IP and competition strategies.
- Enforcing a portfolio of 10 patents in the District of Colorado against a licensee who violated the terms of its license agreement, while defending against counterclaims of patent misuse and anticompetitive conduct.
- Representing a consumer electronics company in patent infringement disputes concerning video displays and video streaming technologies in California federal courts.
- Representing a leading semiconductor company in the Western District of Texas in a patent infringement action involving flash memory technology, including arguing claim constructions before the court.
- Representing a data center infrastructure company against patent infringement claims in multi-district litigation.
- Representing a consumer goods company in multiple lawsuits involving utility patents, design patents, trademarks, and trade dress claims, requiring coordination of a broader IP strategy.
- Representing an eyewear company in asserting patents relating to lens filtering technology.
- Representing a radio equipment manufacturer in a licensing dispute with a former employee.
- Counseling a financial services client on patent landscape trends and outcomes at the U.S. Patent and Trademark Office.
