Gavin Caldwell advises and assists clients with complex commercial contract negotiations, complex technology transactions, data privacy and security, intellectual property, and digital marketing agreements. He has negotiated and drafted contracts for a wide variety of corporate and commercial transactions, including transition services agreements, multimillion-dollar construction agreements, national television commercial production agreements, multimillion-dollar software license and acquisition agreements, joint development and strategic alliance agreements, website terms of use, terms of service for online services, and terms of sale for e-commerce solutions and logistics agreements.

Gavin has provided guidance on development and implementation of data privacy compliance programs, including advising on General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA) compliance, and implemented and negotiated data processing agreements. Gavin’s experience also includes extensive drafting and negotiating of national services agreements for human capital management offered as Software as a Service (SaaS).

Prior to joining Akin Gump in 2021, Gavin was an attorney at a major global law firm. He was previously a senior attorney at one of the fastest growing public technology companies in the world valued at more than $20 billion. While working as an in-house lawyer, he was responsible for advising on the mobile application rollout and placement on distribution platforms including the Apple App Store and Google Play, and for overseeing the company’s compliance with the Telephone Consumer Protection Act (TCPA) and the Controlling the Assault of Non-Solicited Pornography and Marketing (CAN-SPAM) Act.
