Biography
  • Over 20 years of experience advising on major defense acquisitions, including Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS) compliance, bid protests, internal investigations, anti-fraud efforts, and national security–related matters.
  • Extensive experience counseling senior government and industry leaders on complex acquisition structures, transaction-related due diligence, False Claims Act (FCA), and risk mitigation.
  • Former head of the Navy’s contractor compliance and suspension/debarment program, overseeing legal issues across a $130 billion annual procurement portfolio.

Kerry is senior counsel in Akin’s government contracts practice, advising defense, technology and research‑driven clients on complex federal acquisition requirements and high‑stakes enforcement matters. He brings more than 20 years of experience across major defense acquisitions, bid protests, internal investigations, fraud matters and national security‑related issues.

Kerry counsels clients throughout the full lifecycle of federal procurement, including FAR and DFARS compliance, acquisition strategy development, complex indemnification and risk‑allocation issues, major systems contracting and FCA investigations. He is a trusted advisor to senior government and industry leadership and has handled high‑visibility matters involving nuclear and strategic weapons, major weapons systems, space systems, IT modernization initiatives, emergent research programs and other mission‑critical national security efforts.

Before joining Akin, Kerry spent more than 15 years in progressively senior roles at the Department of the Navy. Most recently, he served as Counsel for Strategic Systems Programs (SSP), leading a 25‑person, multi‑site legal team supporting one of the Navy’s most complex weapons portfolios and advising three‑star flag officer. He previously served as the Navy’s Suspension and Debarment Official, overseeing anti‑fraud and compliance efforts across a $130 billion procurement enterprise and managing one of the federal government’s most active suspension and debarment programs. Earlier in his career, Kerry advised on major weapons systems acquisitions, litigated bid protests before the Government Accountability Office (GAO) and the Court of Federal Claims and led internal investigations into significant procurement fraud matters.

Representative Work
  • Regularly advised on strategic and acquisition issues for some of the largest and most complex Department of Defense (DoD) acquisition programs, including the Trident II submarine launched ballistic missile and the hypersonic Conventional Prompt Strike.
  • Resolved complex indemnification issues approved by the Secretary of the Navy related to developing the first U.S. hypersonic missile.
  • Led complex internal fraud and False Claims Act investigations, advising senior leadership on remedial actions, disclosure strategy, and risk mitigation.
  • Led team of Government leaders and industry executives to develop SSP’s long-term acquisition strategy.
  • Counseled on various national security issues, including facility security clearance compliance and Foreign Ownership, Control, or Influence considerations.
  • Defended nearly 50 GAO protests, including several cases involving the use of proprietary data rights by another contractor, and 2 cases at the Court of Federal Claims.
  • Spearheaded several rapid, high-visibility billion-dollar acquisitions with innovative acquisition approaches (such as Other Transaction Authority), including the Department of the Navy’s $80 billion SeaPort Indefinite Delivery/Indefinite Quantity contract for support services.
  • Advised on high-profile $4.3 billion award to modernize DoD’s electronic healthcare system that supports 10 million beneficiaries.
  • Led the Navy’s University Advanced Research Center contracting efforts, advising on FAR-based research contracting, compliance issues, and intellectual property and data rights.
