Kelly Cleary, a partner in Akin Gump’s health care and life sciences practice and a former Deputy General Counsel at the Department of Health and Human Services (HHS), has co-authored a blog post for the USC Schaeffer Center for Health Policy, titled “Will the Rebate Rule need Extra Innings?” The article discusses the ramifications of the Trump administration’s decision to finalize its rule banning rebates on prescription drugs in the Medicare Part D program.

Kelly and her co-authors, two former senior advisors to the HHS Secretary, note that the rule “will almost certainly face legal challenges from impacted stakeholders, especially pharmacy benefits managers.” It may also face opposition, they said, from the incoming Biden administration.
