The OverRuled: BIS Export Controls Module has been updated with the following actions:
- 07 Jun 2023 - Belavia Belarusian Airlines - Finding of Violation
On June 7, 2023, BIS renewed against Belavia Belarusian Airlines ("Respondent") a Temporary Denial Order (TDO) first issued on June 16, 2022 (and renewed on December 13, 2022), for a period of 180 days. Specifically, the Respondent was involved in exporting or reexporting 9A991 aircraft on flights to Belarus and/or Russia after April 8, 2022 without the required BIS authorization. BIS determined that the continued operation of these aircraft by the Respondent and the company's ongoing need to acquire replacement parts and components, many of which are U.S.-origin, presents a high likelihood of imminent violations warranting imposition of a TDO. BIS further determined that such apparent violations were significant and deliberate. Therefore, issuance of the TDO is necessary in the public interest to prevent imminent violation of the Regulations and to give notice to companies and individuals in the United States and abroad that they should avoid dealing with the Respondent in connection with export and reexport transactions involving items subject to the Regulations and in connection with any other activity subject to the Regulations.

On June 8, 2023, BIS renewed the December 13, 2022 Temporary Denial Order (TDO) against Boris Livshits, Svetlana Skvortsova, Aleksey Ippolitov, Advanced Web Services, and Strandway, LLC, and added Nikolaos Bogonikolos and Aratos Group ("Respondents") to that TDO for a period of 180 days. Specifically, BIS determined that the Respondents conspired to violate U.S. export control laws in connection with the procurement and export of controlled electronic signal generator and measurement equipment, advanced electronics, test equipment, antennas, other items to Russia without first obtaining the required U.S. Government authorizations
