The Computer & Internet Lawyer Publishes Akin Gump Article on Considerations When Evaluating Cyber Coverage in Light of New Privacy Laws

The Computer & Internet Lawyer has published the article “Issues to Consider When Evaluating Cyber Coverage in Light of the CCPA and Other State Privacy Laws,” written by Michelle Reed and Natasha Kohne, co-heads of Akin Gump’s cybersecurity, privacy and data protection practice, and litigation counsel Diana Schaffner. The article, which originated as a blog post on the firm’s AG Data Dive blog, looks at some of the key issues companies should consider “as they review their cyber coverage in light of changing legislation and increased litigation risks,” now that the California Consumer Privacy Act has gone into effect.
The authors write that cyber policies “are now a common part of most companies’ insurance portfolios.” They suggest that companies consider several potential gaps in coverage as they evaluate their total coverage. They also advise companies to “carefully note additional obligations that they may need to comply with to ensure coverage” and work those obligations “into their incident response plans, including by assigning responsibility for the tasks to specific members of their incident response teams.”
