Robert Lian and Brian Patterson Author Article for Energy Law Report on Considerations for Employers Considering Staffing Cuts

Robert Lian Jr., head of Akin Gump’s labor and employment practice, and Brian Patterson, a counsel in that practice, have written the article “Effectively Managing Workforce Contraction in Turbulent Times,” which was published by Energy Law Report.
With many energy-related companies considering operational cost-savings measures, including employee reductions, the article provides an outline of the key considerations for employers when dealing with workforce reduction issues. Lian and Patterson write that employers “must tread cautiously” when making plans for adjustments to staffing levels, as there are numerous federal and state employment law issues to consider.
The authors offer some advice on planning in advance for any staffing cuts, including selecting a restructuring team to determine whether layoffs are needed, establishing the rationale for any reductions in ranks, developing selection criteria and analyzing for any discriminatory treat or effect. They then provide some final steps on preparing for any layoffs.
