- 21 Aug 2023 - Ilya Balakaev; Radiotester OOO - Denial Order; No monetary penalty
On August 21, 2023, BIS renewed a Temporary Denial Order (TDO) against Ilya Balakaev and Radiotester OOO a/k/a Radiotester LLC (collectively, “the Respondents”) issued on February 24, 2023 for a period of 180 days in relation to violations of 18 U.S.C. § 554(a). This order went into effect on the Respondents; date of conviction on February 3, 2020. Specifically, the Respondents were convicted of conspiring to willfully export from the United States to Russia and the Democratic People's Republic of Korea, controlled advanced electronics and sophisticated testing equipment, some of which can be used in sensitive foreign counterintelligence and military operations, without the required licenses. BIS did not impose any further monetary penalty on Respondents.
- 22 Aug 2023 - Esteban Andres Alexander - Denial Order; No monetary penalty
On August 22, 2023, BIS issued a Denial Order against Esteban Andres Alexander ("Respondent") for a period of ten years in relation to violations of 18 U.S.C. § 371, the International Emergency Economic Powers Act (50 U.S.C § 1701, et seq.) (“IEEPA”) and 18 U.S.C. § 554. The order went into effect on the Respondent's date of conviction on March 8, 2022. Specifically, the Respondent was convicted of conspiracy to violate IEEPA, exporting and attempting to export, firearms and firearm parts from the United States to Mexico without the required license or written approval. The Respondent was sentenced to 46 months in prison, three years of supervised release, $10,000 fine and a $100 special assessment. BIS did not impose any further monetary penalty on Respondent beyond the Court-imposed penalty.
- 02 Aug 2023 - Tuqiang Xie - Denial Order; No monetary penalty
On August 22, 2023, BIS issued a Denial Order against Tuqiang Xie ("Respondent") for a period of ten years in relation to violations of 18 U.S.C. § 371, the International Emergency Economic Powers Act (50 U.S.C § 1701, et seq.) (“IEEPA”) and 18 U.S.C. § 554. The order went into effect on the Respondent's date of conviction on March 30, 2022. Specifically, the Respondent was convicted of conspiracy to violate IEEPA, attempting to export an eyepiece assembly from the United States to China without the required license or written approval. The Respondent was sentenced to one year and one day in prison, one year of supervised release, a $200 special assessment and a preliminary order of forfeiture in the amount of $200,027. BIS did not impose any further monetary penalty on Respondent beyond the Court-imposed penalty.
- 22 Aug 2023 - Naomi Natal Haynes - Denial Order; No monetary penalty
On August 22, 2023, BIS issued a Denial Order against Naomi Natal Haynes ("Respondent") for a period of ten years in relation to violations of 18 U.S.C. § 371, the International Emergency Economic Powers Act (50 U.S.C § 1701, et seq.) (“IEEPA”) and 18 U.S.C. § 554. The order went into effect on the Respondent's date of conviction on January 11, 2021. Specifically, the Respondent was convicted of conspiracy to violate IEEPA, exporting and attempting to export firearms and firearm parts from the United States to Canada without the required license or written approval. The Respondent was sentenced to 84 months in prison, three years of supervised release, a $200 special assessment and $18,240.18 Restitution. BIS did not impose any further monetary penalty on Respondent beyond the Court-imposed penalty.
