Key Updates

Enforce the Federal prohibition on foreign nationals voting in Federal elections. Requires documentary proof of United States citizenship and for verification from a State or local official for national mail voter registration.

The Commissioner of Social Security shall take all appropriate action to make available the Social Security Number Verification Service, the Death Master File, and any other Federal databases containing relevant information to all State and local election officials engaged in verifying the eligibility of individuals registering to vote or who are already registered. The Election Assistance Commission shall take all appropriate action to cease providing Federal funds to States that do not comply with the Federal laws set forth. 

Orders the Attorney General to enter into information-sharing agreements, to the maximum extent possible, with the chief State election official or multi-member agency of each State to provide the Department of Justice with detailed information on all suspected violations of State and Federal election laws discovered by State officials.
Also orders the Secretary of Homeland Security to coordinate with the Election Assistance Commission to review and report on the security of all electronic systems used in the voter registration and voting process.

Further, directs the Attorney General to prioritize enforcement of 52 U.S.C. 30121 and other appropriate laws to prevent foreign nationals from contributing or donating in United States elections.

Summary

Executive Order 14248 (the “Order”) purports to “protect the integrity of the nation’s election process” by ordering the Election Assistance Committee (“EAC”)—a bipartisan, independent agency tasked with determining the contents of the national voter registration form— to require a passport or other citizenship document to register to vote. The Order also directs the EAC to decertify all state voting machines and cease all federal funds to States that do not comply with the Order.

Plaintiffs are non-partisan voting rights organizations. They argue that the Order is an unlawful attempt by the President to usurp the power to regulate federal elections from the States, Congress, and the EAC. Plaintiffs contend that the Order violates the separation of powers by unconstitutionally exercising congressional and state authority to regulate elections and § 9(a)2 of the National Voting Registration Act. Plaintiffs seek declaratory and injunctive relief, declaring the Order unconstitutional and enjoining the implementation of the Order.

The Executive Order (“EO”) directs the alignment of the U.S. core childhood vaccine schedule with the best practices of peer, developed countries, while preserving access to vaccines and protecting religious freedoms and enforcing legal protections for parents. Based on a scientific assessment completed by HHS pursuant to a Presidential Memorandum dated December 5, 2025, the order notes that the U.S. currently recommends more childhood vaccines than any peer nation and identified a set of consensus vaccines consistently recommended across all peer countries. The order directs the Centers for Disease Control and Prevention (“CDC”) and its Advisory Committee on Immunization Practices (ACIP) to review the scientific assessment and take appropriate steps to update the childhood and adolescent vaccine schedule, while providing maximum flexibility to parents and doctors regarding the timing and sequencing of routine immunizations. Additionally, all immunizations on the ACIP-recommended schedule and adopted by the CDC must continue to be covered without cost sharing by private insurance, Medicaid, the Children’s Health Insurance Program, and the Vaccines for Children Program. The order also reaffirms the Administration’s commitment to fulfilling all legal obligations with respect to parental authority, religious freedom, disability accommodations, and equal protection under the law.
