Summary

The Order suspends the U.S. Refugee Admissions Program (USRAP). Effective January 27, 2025, entry under the USRAP is suspended and decisions on applications for refugee status are suspended. The Secretary of State and Secretary of Homeland Security may jointly determine to admit refugees on a case-by-case basis. Within 90 days, and every 90 days thereafter, the Secretary of State will report to the President whether resumption of USRAP is in the interest of the United States.

The Order rescinds Executive Order 14013 of February 4, 2021.

Summary Plaintiffs (individual refugees, U.S. citizens, and national resettlement organizations) filed a proposed class action seeking declaratory and injunctive relief against Defendants (President Donald J. Trump, Secretary of State Marco Rubio, Secretary of Homeland Security Kristi Noem, and Secretary of Health and Human Services Dorothy A. Fink) for an Executive Order barring entry for all refugees, suspending decisions on refugee applications for an indefinite time period, and cutting statutorily mandated funding to third-party agencies. Plaintiffs argue the order is a violation of the Refugee Act of 1980, the Administrative Procedure Act, the Due Process Clause of the Fifth Amendment, the Immigration and Nationality Act, and fundamental separation-of-powers principles. 
Case Updates On Feb. 28, Judge Whitehead issued a written opinion granting the Plaintiffs a nationwide preliminary injunction.
