Akin Gump Partners Speak with Practical Law for Q&A on Arbitration in the UK

Contact:
Practical Law has once again published a Q&A column with Akin Gump international arbitration and dispute resolution partners Justin Williams, Hamish Lal and Richard Hornshaw on “Arbitration procedures and practice in the UK (England and Wales): overview.” The article looks at the use of arbitration and recent trends in the United Kingdom, as identified by the authors.
Williams, Lal and Hornshaw write that, while commercial arbitration remains the preferred dispute resolution procedure for international transactions, “the full implications of Brexit for arbitration in the UK are being closely monitored by practitioners.” As of now, it does not appear to have had any immediate impact. The three go on to discuss some of the advantages and disadvantages of arbitration, before turning to applicable legislation and the topic of mandatory legislative provisions.
The Q&A also covers the following topics:
- The law of limitation.
- Commonly used arbitration organizations.
- Jurisdictional issues.
- The requirements for an arbitration agreement to be enforceable.
