Law360 has published the article “What UK Panel’s Cryptoasset Update Does And Doesn’t Clarify,” written by Akin Gump litigation partner Mark Dawkins and counsel Jenny Arlington. The article, which is based on an Akin Gump client alert, discusses the recent publication of “the first legal statement globally, which clarifies the legal status of cryptoassets and smart contracts.”

The article describes the statement, issued by the U.K. Jurisdiction Taskforce, as a response to “perceived uncertainty among market participants about the status and enforceability of these instruments.” While not binding, the authors note that the statement is persuasive and, “although it is confined to English law, it will likely impact other common law jurisdictions.”
