“Key Points From New Blockchain Legal Guidance,” an article by Akin Gump litigation partner Mark Dawkins and counsel Jenny Arlington, has been published by Law360.
The article discusses legal and regulatory guidance on issues concerning blockchain published by The Law Society and the blockchain group of Tech London Advocates. Though not legally binding, the guidance, write the authors, was welcomed by developers and users of blockchain and endorsed by the chair of the U.K. Jurisdiction Taskforce.
The guidance addresses eight areas of law and regulation regarding blockchain and provides recommendations, including best practices for legal professionals and requests for further regulatory clarifications.
The authors offer a high-level overview of the guidance, sketching out the topics discussed therein, and also look ahead via the action points identified in the guidance, which include specific steps such as engaging in dialogue with the relevant regulators.
They close by noting, “The legal questions raised by the increased use and the constantly evolving nature of these technologies will undoubtedly continue at pace. There is every reason to believe that those questions will be answered at equal pace, especially in light of the inherent adaptability and flexibility of English law.”
