Contact:
Practical Law has published the Q&A column “Arbitration procedures and practice in the UK (England and Wales): overview,” featuring Akin Gump international arbitration and dispute resolution partners Justin Williams, Hamish Lal and Richard Hornshaw. The article, as Practical Law notes, “provides a structured overview of the key practical issues concerning arbitration” in England and Wales.
Williams, Lal and Hornshaw point out that, while commercial arbitration remains the preferred dispute resolution procedure for international transactions, “the full implications of Brexit for arbitration in the UK are being closely monitored by practitioners.” As of now, it does not appear to have had any immediate impact. The three go on to discuss some of the advantages and disadvantages of arbitration, before turning to applicable legislation and the topic of mandatory legislative provisions.
The Q&A also covers the following topics:
- The law of limitation.
- Commonly used arbitration organizations.
- Jurisdictional issues.
- The requirements for an arbitration agreement to be enforceable.
