In Law360 Article, Akin Gump Cyber Team Looks Back at First Six Months of CCPA

Law360 has published the article “Lessons From 6 Months Of Calif. Privacy Law Litigation,” written by Natasha Kohne and Michelle Reed, co-heads of Akin Gump’s cybersecurity, privacy and data protection practice, and counsel Molly Whitman. The article discusses the California attorney general’s final draft of proposed regulations pertaining to the California Consumer Privacy Act (CCPA), which took effect at the beginning of the year.
The authors examine the CCPA’s private right of action, looking at expected litigation trends, cases that exceed the boundaries of the limited private right of action, and some cases that use the CCPA to bolster other causes of action.
Looking ahead, the authors do not expect a slowdown in the pace of consumer class actions alleging some form of a CCPA violation. In fact, they write, they say the next six months will see “a flurry of continued activity in both consumer class actions and state enforcement.”
