Labor and Employment > Executive Disputes and Agreements

Akin Gump Strauss Hauer & Feld LLP’s lawyers regularly represent clients in critical and high-stakes employment matters involving senior company personnel, including disputes regarding the termination of executives and other senior personnel; claims over severance, change-in-control payments and benefits; and disputes over non-competition, non-solicitation, confidentiality provisions or other restrictive covenants in the “war for talent.” We also tackle claims alleging breach of the duty of loyalty, misappropriation of trade secrets, unlawful competition and other contractual or tort claims. Our clients in executive disputes include both companies and individuals, and we have experience pursuing and defending such actions. We are familiar with the unique issues that can accompany such disputes—including potential disclosure obligations and the impact disputes can have on important constituents such as investors—and are sensitive to these issues in developing our litigation strategies.

Our lawyers also regularly advise companies and senior personnel in non-litigation matters, including negotiating employment agreements and separation agreements, advising in connection with work-related misconduct and similar issues and advising our clients on “best practices” in the labor and employment area. We pride ourselves in providing legal advice that is not only sound but practical in light of our clients’ particular businesses, needs and interests.

We also have substantial experience in representing professional sports teams, leagues and organizations in disputes with their players, umpires and referees. We have represented a professional sports league’s management group in a wide range of player arbitrations, including achieving highly publicized victories in several major cases. We also have successfully represented a major league baseball team in player salary arbitrations, as well as handled player disciplinary grievances and other matters.
