Government Contracting Law Report Publishes Akin Gump Analysis of Cyber and Supply Chain Security Executive Order

Government Contracting Law Report has published the article “President Biden Issues Executive Order to Overhaul Cyber and Software Supply Chain Security and Expand Incident Reporting for Contractors.” Adapted from an Akin Gump client alert, the article was written by cybersecurity, privacy and data protection practice heads Natasha Kohne and Michelle Reed; government contracts practice head Michael Vernick, fellow government contracts partners Scott Heimberg and Angela Styles and associate Chris Chamberlain; and litigation counsel Molly Whitman.

The article discusses an executive order (EO) signed by President Biden responding to “years of increasing concern about, and efforts to enhance, cyber and supply chain security within the federal government, its contracting base and the U.S. information and communications technology and services industry.” It also outlines significant developments “in various other aspects of federal cybersecurity policy.”

The EO as well as its related rulemakings, the authors write, will significantly impact government contractors, software companies and others “most notably through adding or enhancing incident reporting requirements and attestations related to software development and acquisition practices.” As a result, they say, “it will be critical for potentially affected contractors and other stakeholders to closely monitor the various timelines and releases laid out in the order.”
