Antitrust/Competition > Antitrust Policy and Regulation

Antitrust issues are often infused with policy concerns and arise in connection with federal and state regulatory and legislative matters. Akin Gump Strauss Hauer & Feld LLP lawyers have provided counseling and strategic planning advice in connection with legislative proposals, congressional investigations and proposed mergers and acquisitions, as well as in other situations. Our work in this area is strategic and forward-looking. It includes:

  • representing a sovereign nation before the U.S. departments of State and Justice (DOJ) in successfully arguing for nonprosecution of a company domiciled in that country despite global prosecution of numerous similarly situated companies
  • represented various industry organizations in connection with advocacy related to passage of the Affordable Care Act
  • representing publicly traded companies on congressional interest in numerous mergers and acquisitions presenting significant antitrust concerns
  • represented a pharmaceutical manufacturer and a group purchasing organization in connection with congressional inquiries into antitrust issues regarding, respectively, product innovation and purchasing of innovative products
  • represented a health system in negotiations with the Centers for Medicare & Medicaid Services (CMS) and the DOJ over antitrust concerns arising from participation in CMS programs under the Affordable Care Act
  • authored amicus curiae briefs in the U.S. Supreme Court on cases involving price squeeze, scope of antitrust grand jury subpoenas and proceedings for class certification
