Brecken advises clients on environmental due diligence and permitting, regulatory compliance and enforcement, and climate and sustainability disclosure. She counsels public and private companies across a range of industries—including renewable energy, consumer products, mining, manufacturing, rail and oil and gas—on managing environmental risk in transactions and navigating complex federal and state regulatory regimes.
Her experience includes representing clients in federal investigations and enforcement matters involving the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) and the Clean Air Act, as well as counseling companies on climate reporting obligations, including California’s climate disclosure requirements and the European Union’s (EU) Corporate Sustainability Reporting Directive (CSRD). Brecken regularly supports buy‑side transactions, where she conducts environmental diligence, reviews permit transferability and works closely with environmental consultants, Akin deal teams and insurers to help clients assess environmental liabilities.
Brecken maintains an active pro bono practice focused on asylum representation, housing security and wilderness protection matters. Prior to joining Akin, she clerked for the U.S. District Court for the District of Kansas.
- Counseled buyers on environmental due diligence, permitting risk and disclosure matters in connection with acquisitions and project development across the mining, renewable energy and transportation sectors, including a mine acquisition, multistate solar and battery energy storage system (BESS) projects, and a multinational rail-related business acquisition.
- Advised companies across the chemicals, consumer products and oil and gas sectors in federal environmental enforcement matters, including CERCLA negotiations with the U.S. Environmental Protection Agency (EPA) and other potentially responsible parties, Clean Air Act enforcement proceedings involving the U.S. Department of Justice and the EPA, and FIFRA matters related to pesticide device labeling and import compliance.
- Counseled global consumer brands and financial services companies on climate and sustainability disclosures, including California’s SB 261 climate‑related financial risk requirements, CSRD reporting obligations and review of public sustainability statements.
